Support [UPDATE! 07.28.00] It was just brought to my attention that a company known as Comfortmaker has a line of air conditioning units known as the AG, as well as, yup, an AJ series. Should I surrender my first name to them? This all goes to show, if nothing else, I'm *damn* cool! Where it all began: The following mails are from a representative of Thomas and Betts, one Patrick Turner. As you will see through these emails and replies, we were both rather cordial with each other. However, also evident will be that, sadly, Mr. Turner doesn't really seem to be able to call shots, so to speak. Rather unfortunate as he was rather pleasant to deal with, unlike what I presume the rest of Thomas and Betts to be like. * * * * * Mail #1: Date: Thu, 22 Jul 1999 17:39:53 -0500 From: Patrick Turner To: aj@reznor.com Subject: reznor.com AJ, first off, great web site. Pretty wild stuff you've got on here. To the point, I'm with Reznor (the heater company named after your family), and we'd like to acquire the reznor.com domain name. Wondering what it would take? Thanks, Patrick patrick_turner@tnb.com * * * * * I was, of course, tempted to double-one up cDc and tell them "two monster trucks *and* two million dollars." I decided against this, and to be a nice guy for a change (yeah, look where it got me). The next piece is again from Mr. Turner and includes my replies, and his responses: * * * * * Mail 2: Date: Fri, 23 Jul 1999 14:46:20 -0500 From: "Patrick Turner" To: aj@reznor.com Subject: Re: reznor.com No problem. I understand just how you feel. If I'd received the e-mail from you, I'd have had the same response. How about a link sharing deal (where I link to you, and you link to me)? I don't even know if my managers would go for it, but it's worked in the past... By the way, are you related to George (Trent's grandfather)? He invented the unit heater (and thus founded my company) in Mercer, PA some 110 years ago. More to come, I assure you! >To the point, I'm with Reznor (the heater company named after your >family), and we'd like to acquire the reznor.com domain name. Wondering >what it would take? Well, this is where I bite my tongue and for once hold back my scathing rhetoric :) To be point blank and not string you along, the name is not something I can consider parting with. Tho the site is still festering into my larger ideal, the name is as much a part of me as anything, and must decline your offer. For what it's worth, reznor.org is available (tho you aren't an actualy org, InterNIC stopped being too tight about it since they botched things up ages ago). Also, reznor.net doesn't resolve and is therefore probably not in use at all. Sorry I couldn't give the response you'd like to hear. -aj. * * * * * Note: since this was written, in addition to good old reznorsucks.com, Thomas and Betts also added to their stable reznor.net and reznor.org. As I stated in the mail, reznor.net *was* taken, and unused. Somehow (I am guessing through legal discourse, as was attempted with myself) TnB grabbed reznor.net. It is also worth mentioning that www.reznor.net is not resolving, nor in my occasional checks have I ever seen it work. Domain squatting, perhaps? Why did they need it so badly? * * * * * Mail 3: Date: Tue, 27 Jul 1999 08:15:16 -0500 From: "Patrick Turner" To: aj@reznor.com Subject: Re: reznor.com My managers decided they didn't want our site pointing to a non business oriented site, so I guess we're stuck finding ourselves on our own. Thanks for the responses though, and keep up the great web site. By the way, the hand piercings almost made us lose our lunch. Don't know how you handled those. Yikes!!! I had actually considered suggesting this, but was going to wait for your reply ;) -aj. * * * * * In their letter from their attorneys, Thomas and Betts points out that they currently possessed about a dozen domain names containing their trade name "Reznor". Among the obvious questions ("Then why the hell do they need *mine*?") are a few others that are worth considering. The domains I find registered to Thomas and Betts: reznoronline.com (06-aug-1999) (apparently this was an afterthought) reznorsucks.com (08-sep-1999) reznornorthamerica.com (05-apr-1999) reznorhvac.com (05-apr-1999) reznorheating.com (05-apr-1999) reznorheaters.com (05-apr-1999) reznoreurope.com (05-apr-1999) reznoraustrialia.com (05-apr-1999) (yes, spelled incorrectly!) reznorasia.com (05-apr-1999) reznor.net (31-Mar-1999) Of *all* of these, Thomas and Betts uses only *ONE* name, and that is www.reznoronline.com. Personally, I hate companies using (anything)online.com. DUH! Of course it's online, it's staring at us in our browser! The more obvious choice, reznorhvac.com, or even reznorheaters.com, are not employed. Interesting that reznorwasteoil.com is not owned by TnB, but continues to operate. This is perhaps because of a graphic that states that "reznor is a brand of thomas and betts." I wonder how many attorneys and threatening letters it took to get that added.... One other similarly named domain, reznorparts.com, is not owned by Thomas and Betts, but is non functional. Reznor.org points to namezero.com. These are logs of hits from known Thomas and Betts IPs. The above two links near the top of the page will skip you past them. Of interest. Thomas & Betts owns the block of IP addresses covereing 208.5.87.0 to 208.5.87.255. This per ARIN: Thomas & Betts Corporation (NETBLK-IXLTNB-1) IXLTNB-1 208.5.87.0 - 208.5.87.255 Per the logs for www.reznor.com, we see that their first hit to my site was June 15th: 208.5.87.66 - - [15/Jun/1999:09:18:49 -0700] "GET / HTTP/1.0" 200 610 208.5.87.66 - - [15/Jun/1999:09:18:50 -0700] "GET /imgs/rat1.jpg HTTP/1.0" 200 46526 That was it, two simple hits to the opening page, not even the main content page, just the opening graphic (temporarily on hold during this saga, so the notice letter I drafted could be displayed). The next hits were not until July 9th: 208.5.87.66 - - [09/Jul/1999:08:36:59 -0700] "GET / HTTP/1.0" 200 610 208.5.87.66 - - [09/Jul/1999:08:37:00 -0700] "GET /imgs/rat1.jpg HTTP/1.0" 200 46526 208.5.87.66 - - [09/Jul/1999:08:37:35 -0700] "GET /index2.html HTTP/1.0" 200 3480 208.5.87.66 - - [09/Jul/1999:08:37:36 -0700] "GET /imgs/dunelogo.jpg HTTP/1.0" 200 12715 208.5.87.66 - - [09/Jul/1999:08:37:36 -0700] "GET /imgs/joshua.jpg HTTP/1.0" 200 14505 In this round, nearly a month after the first hits, they finally found the link at the top (or clicked on the big graphic, I made it *real* hard to get inside). The third instance of an IP from the Thomas and Betts block comes on July 22nd (the day I received the first mail from Mr. Turner): 208.5.87.66 - - [22/Jul/1999:15:43:14 -0700] "GET / HTTP/1.0" 200 610 208.5.87.66 - - [22/Jul/1999:15:43:15 -0700] "GET /imgs/rat1.jpg HTTP/1.0" 200 46526 208.5.87.66 - - [22/Jul/1999:15:43:17 -0700] "GET /index2.html HTTP/1.0" 200 4079 208.5.87.66 - - [22/Jul/1999:15:43:18 -0700] "GET /imgs/dunelogo.jpg HTTP/1.0" 200 12715 208.5.87.66 - - [22/Jul/1999:15:43:18 -0700] "GET /imgs/joshua.jpg HTTP/1.0" 200 14505 208.5.87.66 - - [22/Jul/1999:15:43:39 -0700] "GET /mirrors/ HTTP/1.0" 200 1388 208.5.87.66 - - [22/Jul/1999:15:43:49 -0700] "GET /mirrors/arwen_nasa/nasa1.html HTTP/1.0" 200 3535 208.5.87.66 - - [22/Jul/1999:15:43:50 -0700] "GET /mirrors/arwen_nasa/vikings0.gif HTTP/1.0" 200 3139 208.5.87.66 - - [22/Jul/1999:15:43:50 -0700] "GET /mirrors/arwen_nasa/back0000.gif HTTP/1.0" 200 279 208.5.87.66 - - [22/Jul/1999:15:43:50 -0700] "GET /mirrors/arwen_nasa/eye00000.gif HTTP/1.0" 200 357 208.5.87.66 - - [22/Jul/1999:15:45:09 -0700] "GET /aj/ HTTP/1.0" 200 2979 208.5.87.66 - - [22/Jul/1999:15:45:46 -0700] "GET /aj/index2.html HTTP/1.0" 200 3121 208.5.87.66 - - [22/Jul/1999:15:47:25 -0700] "GET /aj/advice.html HTTP/1.0" 200 2220 208.5.87.66 - - [22/Jul/1999:15:48:59 -0700] "GET /aj/shavedpussy.jpg HTTP/1.0" 200 57089 208.5.87.66 - - [22/Jul/1999:15:53:04 -0700] "GET /aj/hand3a.jpg HTTP/1.0" 200 37495 208.5.87.66 - - [22/Jul/1999:15:54:11 -0700] "GET /aj/r90s.jpg HTTP/1.0" 200 33614 208.5.87.66 - - [22/Jul/1999:15:54:20 -0700] "GET /aj/k100.jpg HTTP/1.0" 200 36284 208.5.87.66 - - [22/Jul/1999:15:54:32 -0700] "GET /aj/eddie.jpg HTTP/1.0" 200 57071 Abbreviated analysis, into page, main page, mirrors, my personal stuff. Other blurbs and whatnot, filtered out of the bile floating around the Net: The following is from a law-related mailing list. As I am not a subscriber to the list, I will be blocking out the names of all involved: According to yesterday's Los Angeles Times, the ninth circuit on Monday reversed the lower judge's finding that Jerry Sumpton and his company FreeView Listings were cybersquatters when they registered avery.net and dennison.net. Sumpton's company leases domains to people whose names match the domain so that they may enjoy their own "vanity" e-mail address. According to the Times, the court's decision "places a heavy burden on companies to show that someone who has registered its name did so to cash in on the trademark's value." The court also rejected Avery's argument that its marks wwere so famous as "to warrant exclusive use. The court noted that 'Avery' and 'Dennison' are common surnames, and that others have a right to use them." I haven't read the opinion yet, but it can be found on the net at: http://caselaw.findlaw.com/cgi-bin/getcase.pl?court=9th&navby=case&no=9855810 Also, a former contributor to cyberia, XXXXXX YYYYYY, commented on the decision: "Until now a lot of people thought that if you own a trademark you could go to court and [automatically] stop someone else from registering a domain name that matches your trademark. Now, people who register domain names in good faith -- not to extort or confuse anyone -- may win even if the domain name happens to match somebody else's trademark." ***** From an editorial by Jack Rickard, Boardwatch Magazine, March 1996: "The InterNIC has already developed their policy document into something so badly written and complicated that it makes Fidonet documentation actually look lucid if you can picture it. Basically, if you have a domain name and someone comes up with proof of registration of that name as a federally registered trademark, they give you 30 days to come up with your own federal trademark registration information. In the event of a tie, they put the name on HOLD and force you to arbitrate it. I can't imagine this making anything go away. It looks like law written by a computer geek, which is about how it happened I suspect." This is all very good and all, and makes a solid point. Well, as solid as can be made given the documentation available on the subject. But read on: "The problem is that there is a very clear exception to trademark protection written into the trademark law. If your personal name is really BRYANT or NEWTON, your rights to your own name cannot be abrogated by any trademark registration. InterNIC is sitting on a time bomb waiting for someone named NEWTON or BRYANT who isn't poor as a church mouse to blow this one up in their face." A quick definition of "abrogated" take from www.dictionary.com: To abolish; annul; do away; set aside; revoke; repeal; cancel; annihilate. See Abolish. So, while trademark law may protect corporations from other corporations as far as domain registration, trademark law specifies that an individual's rights to their name cannot be negated by any trademark registration coinciding with that individual's name. Couple this with the fact that I am, and have been running a legitimate site focused around me and my ego, with a splash of culture and technology thrown in, I cannot possibly be diluting the trademark, as suggested in the letter I receive from the attorneys. Consider that no where do I even mention CPU fans and cooling devices. I *do* link to the Celeron Overclocking FAQ which deals with CPU heat when overclocking. Perhaps a lawsuit should be levied against them and not I? ;) Support

More are lined up pending author approval. ***** From: (obscured) Date: Thu, 31 Aug 2000 Subject: Check out Thomas & Betts performance Today's paper yields an interesting story in the saga of T&B's pitiful performance. They are being sued in a possible class action suit for misrepresenting their financial performance. Look at a graph of their stock price. It has taken a down hill slide in an up market. Management at Reznor is small minded, petty and self serving. They are the slackest group of people you will ever meet. Their response to you is only typical of their mindset on a daily basis. ***** From: (obscured) Hi, I was typing various names into my browser and stumbled upon your site. As I was reading about your trouble with the name "Reznor", I just had to laugh. Having worked at F.L. Reznor for a number of years, I am all too familiar with these idiots! Notice the F.L.? That stands for (I'm hoping this is right) Forrestor and Little. These guys are major Wall Street investment bankers and were actually mentioned in the HBO movie "Barbarians at the Gate." The movie about the takeover of RJR Nabisco back in the 80s. These guys owned Reznor for a while and then sold it to (I think) American Electric in Tennessee. To my way of thinking, the name had been deluded long before you registered it. Ok, now for a little history of the Reznor eluded to by the lawyers. Reznor is one of the largest manufacturers of commercial heaters and air-conditioners in the world. Their main plant sits in the town of Mercer, Pennsylvania as it has since 1888. By a strange quirk of fate (not really) Trent Reznor of Nine-Inch-Nails fame hails from that same small town. As a matter of fact, his father, Mike, was the first person that I took acoustic guitars lessons from oh so many years ago.. The same county has sported it fair share of judges and county commissioners with the Reznor name. It doesn't surprise me that they would try something like this. The pin-heads that I used to have to deal with there were completely out of touch with the real world and wouldn't know technology if it jumped up and bit them in the ass! At any rate, fight the good fight and good luck! (obscured) ex-Reznor employee.. ***** From: (obscured) Mr. Reznor, I am in the HVAC business, and was on the web looking for the Reznor unit heater site for some acoustical information. I couldn't find a Reznor site via search engine, so I finally typed in the obvious - www.reznor.com - and came across you're "open letter" about your dealings with the Reznor company. Holy cow! Despite the fact I still haven't found the Reznor site (if one even exists), I can't believe the B.S. they're throwing your way. Sorry to hear about it all, and more power to ya to keep the domain name. BTW - you're right: when you put in "Reznor" in a search engine, the entire first page of responses are all devoted to Nine Inch Nails and Trent Reznor. I got a good laugh out of that. (obscured) ***** From: (obscured) In my search for info on the band nine inch nails I came across your site. Beautiful soliloquy. I'm with you all the way. "Education makes a people easy to govern, but impossible to enslave." ~Kierkegaard ***** From: (obscured) don't give in to Betts. kick ass. ... A few years ago Betts used a picture of the founder of the Reznor Mfg. Co. (George Reznor) in a magazine ad (national trade magazine). They were apparently trying to use the "nostalgia" aspect in the ad. Someone in the company decided George Reznor's name wasn't good enough. They intentionally and dishonestly decided to add the name Thadeus to his name because they thought it would be more 'marketable'. So much for goodwill and the Reznor name. They cooked up George Thadeus Reznor. which was not only an insult to the descendents of George Reznor but it puts in print a falsehood to the real facts of the good and historical name of George Reznor. Having read your piece again... don't sell. ***** From: (obscured) i found your site hoping to see things about trent reznor, but instead read about the CRAP you are going through. did these people ever think to try reznor.net or reznor.org... well, anyways i hope it works out for you & if you ever want to get rid of your site i hope you would offer it to Trent just to stick it to the other people. :) have a great day! ***** From: (obscured) WAY TO GO BIG GUY. i WAS GOING TO USE SOME OF THERE EQUIPMENT BUT NOT NOW. ***** From: (obscured) AJ: Way to go buddy! This is your site and you have the ability to really get ugly with Reznor. But you kept it clean. You've got class! I don't know you, but I'm proud of you. All too often people stoop to the levels of the antagonizers, and blow it. Keep your chin up and keep playing fair, even if they won't. (obcured) ps: as a mechanical engineer, I was looking for Reznor Gas Fired Products for information. I'm not gonna start boycotting them or anything. I just like to see "the little guy" stand up for himself. now back to surfing. ***** From: (obscured) I applaud your continued perseverance in keeping your domain name. I wish more people would stand up for themselves as you have done. I believe if people would do so more, our society would be an easier one to live in minus big business contaminating valuable web space. Thank You for being stubborn Sincerely, (obscured) ***** From: (obscured) My name is (obscured) and after reading your article about your impending battle with T & B I felt obligated to give you a little history regarding Reznor. I am (obscured) of (obcured). One of the product line we've represented and distributed since my grandfather started the company is Reznor. I'm not in the loop of Trent Reznor and though this may be old news, Trent Reznor is the son of a Reznor (George, I think) who was one of the owners of Reznor Mfg Co. (I would think if anyone is heir to the name Reznor it would be a Reznor, if that is the way it worked) Reznor was family owned for many years until ITT bought them. ITT did what ITT does and bled the company until it almost died. Reznor was then sold to Forstman & Little, another conglomerate who built them up, packaged them with several other companies then sold them off to T & B. How anyone came up with the year 1949 as the time when T & B owned Reznor is beyond me.... T & B purchased Reznor in the 80's. I wish you luck. Very truly yours, (obscured) ***** From: (obscured) I reached your site while looking for Thomas & Betts - Reznor and found your dissertation to be hilarious. I hope you get to keep your domain name. ***** From: (obscured) AJ, Hey, I needed a part from REZNOR and said to myself(after getting the run around from the local supplier here) what the hell, maybe they have a web site.....so I punched in WWW.REZNOR.COM and lo and behold, I got to read your statement. Well..I got to tell you, I really need the part but I AM ON YOUR SIDE. The big guys need to be put back a step or two. and I (if I were you) would not budge or I would tell them that everything is for sale...(How's a couple million sound) and see if they would like to contribute to the REZNOR.COM retirement fund.....so.......just want to tell you good luck and GIVE THEM HELL! ***** From: (obscured) To: technicalsupport@tnb.com CC: aj@reznor.com To T & B indistries: you are heartless souls who will do anything to get what you want with money and power. How can you sleep at night? what does the name Reznor have to do with your company name? you are all a bunch of corporate pigs who don't deserve to earn the money you make in the online industry. What right do you have to take a domain away from someone who obviously had it before you? It amazes me what levels businessmen will stoop to! To Aj Effin Reznor: Good for you! I'm glad you got to keep the domain and kicked those incosiderate slugs to the curb. I'm glad that there are certain people who won't tolerate such things and will stand up for what they believe in! I commend your bravery and boldness. Sincerely, (obscured) a compassionate antiestablishmentarian. ***** From: (obscured) Mr. Reznor, I ran across your web page trying to find the "actual" Reznor site, the affiliate and subsidiary of Thomas & Betts. I'm new to the HVAC Industry, personally, I'm in it because it's a job that pays my bills. I just wanted to give you a quick hello and a big "hell yeah" for sticking to your guns. I work for a wholesale distribution outfit in LA and we deal in Thomas & Betts & Reznor products all the time... to think that these slack-jawed troglodytes think they can push around anyone they want on the net is absolutely ridiculous! I'm glad at least one person out there has the balls to stay true! Kudos to you! Keep up the good work, and let me know if you need any help spreading the "good" word! ***** From: (obscured) AJ, Hang in there man! Great to see someone standing up for what is rightfully theirs! I can't believe those guys don't have better things to do than harass you for your domain name. ***** From: Aaron Crandall [acrandal@XYZ.edu] To: aj@reznor.com You've got legal rights to it! Here in Denmark we have a simple rule: Who regs it first, gets it first. Forever. If some bigshot company got their name registered, too bad. This does have a few side effects though, like the local ISP's who regged every name in the phonebook and then started selling them at much higher cost. But still, when you get a domain, its secured. Weird how it's always private people who are getting stamped on. I doubt I'd get redhat.com if I told them my family have been running a bar called just that for over 50 years. Oh well, keep it up. Don't let them get you. Regards, -- Phoz [root@phoz.dk] http://www.phoz.dk PGP: pgp@2600.dk ***** From: [name withheld] To: aj@reznor.com Hey AJ.. I'm involved in the HVAC industry - this is quite funny that that want to hold to their reputation. I wonder if they want the reputation of fucking small companies by dropping pricing till they have a monopoly. cheers, XX *****
