[UPDATE! 07.28.00] It was just brought to my attention that a company known
as Comfortmaker has a line of air conditioning units known as the AG, as
well as, yup, an AJ series. Should I surrender my first name to them?
This all goes to show, if nothing else, I'm *damn* cool!
Where it all began:
The following mails are from a representative of Thomas and Betts, one Patrick
Turner. As you will see through these emails and replies, we were both rather
cordial with each other. However, also evident will be that, sadly, Mr. Turner
doesn't really seem to be able to call shots, so to speak. Rather unfortunate as
he was rather pleasant to deal with, unlike what I presume the rest of Thomas
and Betts to be like.

Well, this is where I bite my tongue and for once hold back my scathing
rhetoric :)
To be point blank and not string you along, the name is not something I can
consider parting with. Tho the site is still festering into my larger
ideal, the name is as much a part of me as anything, and must decline your
offer.
For what it's worth, reznor.org is available (tho you aren't an actualy
org, InterNIC stopped being too tight about it since they botched things up
ages ago). Also, reznor.net doesn't resolve and is therefore probably not
in use at all.
Sorry I couldn't give the response you'd like to hear.

Note: since this was written, in addition to good old reznorsucks.com, Thomas and
Betts also added to their stable reznor.net and reznor.org. As I stated in the
mail, reznor.net *was* taken, and unused. Somehow (I am guessing through legal
discourse, as was attempted with myself) TnB grabbed reznor.net. It is also worth
mentioning that www.reznor.net is not resolving, nor in my occasional checks have
I ever seen it work. Domain squatting, perhaps? Why did they need it so badly?

In their letter from their attorneys, Thomas and Betts points out that they currently
possessed about a dozen domain names containing their trade name "Reznor".
Among the obvious questions ("Then why the hell do they need *mine*?") are a few
others that are worth considering.
The domains I find registered to Thomas and Betts:
reznoronline.com (06-aug-1999) (apparently this was an afterthought)
reznorsucks.com (08-sep-1999)
reznornorthamerica.com (05-apr-1999)
reznorhvac.com (05-apr-1999)
reznorheating.com (05-apr-1999)
reznorheaters.com (05-apr-1999)
reznoreurope.com (05-apr-1999)
reznoraustrialia.com (05-apr-1999) (yes, spelled incorrectly!)
reznorasia.com (05-apr-1999)
reznor.net (31-Mar-1999)
Of *all* of these, Thomas and Betts uses only *ONE* name, and that is
www.reznoronline.com. Personally, I hate companies using (anything)online.com.
DUH! Of course it's online, it's staring at us in our browser! The more obvious
choice, reznorhvac.com, or even reznorheaters.com, are not employed. Interesting
that reznorwasteoil.com is not owned by TnB, but continues to operate. This is perhaps
because of a graphic that states that "reznor is a brand of thomas and betts."
I wonder how many attorneys and threatening letters it took to get that added....
One other similarly named domain, reznorparts.com, is not owned by Thomas and Betts,
but is non functional.
Reznor.org points to namezero.com.
These are logs of hits from known Thomas and Betts IPs. The above two
links near the top of the page will skip you past them.
Of interest. Thomas & Betts owns the block of IP addresses
covereing 208.5.87.0 to 208.5.87.255. This per ARIN:

Per the logs for www.reznor.com, we see that their first hit to my site
was June 15th:

I was alerted to WWW.SHOWTIME.COM, which has NOTHING to do with a certain channel
of the same name, by Emmanuel from 2600. They include a link to "Who we are not" which
not only clearly defines them as NOT being a certain channel, but goes so far as to imply that
the channel's competitors are of a higher quality.

According to yesterday's Los Angeles Times, the ninth circuit on Monday
reversed the lower judge's finding that Jerry Sumpton and his company
FreeView Listings were cybersquatters when they registered avery.net and
dennison.net. Sumpton's company leases domains to people whose names match
the domain so that they may enjoy their own "vanity" e-mail address.
According to the Times, the court's decision "places a heavy burden on
companies to show that someone who has registered its name did so to cash
in on the trademark's value." The court also rejected Avery's argument
that its marks wwere so famous as "to warrant exclusive use. The court
noted that 'Avery' and 'Dennison' are common surnames, and that others have
a right to use them."

From an editorial by Jack Rickard, Boardwatch Magazine, March 1996:
"The InterNIC has already developed their policy document into something so badly written and
complicated that it makes Fidonet documentation actually look lucid if you can picture it.
Basically, if you have a domain name and someone comes up with proof of registration of that
name as a federally registered trademark, they give you 30 days to come up with your own federal
trademark registration information. In the event of a tie, they put the name on HOLD and force
you to arbitrate it. I can't imagine this making anything go away. It looks like law written by
a computer geek, which is about how it happened I suspect."
This is all very good and all, and makes a solid point. Well, as solid as can be made given
the documentation available on the subject. But read on:
"The problem is that there is a very clear exception to trademark protection written into the
trademark law. If your personal name is really BRYANT or NEWTON, your rights to your own name
cannot be abrogated by any trademark registration. InterNIC is sitting on a time bomb waiting
for someone named NEWTON or BRYANT who isn't poor as a church mouse to blow this one up in their
face."
A quick definition of "abrogated" take from www.dictionary.com:
To abolish; annul; do away; set aside; revoke; repeal; cancel; annihilate. See Abolish.
So, while trademark law may protect corporations from other corporations as far as domain
registration, trademark law specifies that an individual's rights to their name cannot be
negated by any trademark registration coinciding with that individual's name.
Couple this with the fact that I am, and have been running a legitimate site focused around me

I was typing various names into my browser and stumbled upon your site.
As I was reading about your trouble with the name "Reznor", I just had to
laugh.
Having worked at F.L. Reznor for a number of years, I am all too familiar with
these idiots! Notice the F.L.? That stands for (I'm hoping this is right)
Forrestor and Little. These guys are major Wall Street investment bankers and
were actually mentioned in the HBO movie "Barbarians at the Gate." The movie
about the takeover of RJR Nabisco back in the 80s. These guys owned Reznor
for a while and then sold it to (I think) American Electric in Tennessee.
To my way of thinking, the name had been deluded long before you
registered it.
Ok, now for a little history of the Reznor eluded to by the lawyers.
Reznor is one of the largest manufacturers of commercial heaters and
air-conditioners in the world. Their main plant sits in the town of
Mercer, Pennsylvania as it has since 1888. By a strange quirk of fate (not
really) Trent Reznor of Nine-Inch-Nails fame hails from that same small
town. As a matter of fact, his father, Mike, was the first person that I
took acoustic guitars lessons from oh so many years ago..
The same county has sported it fair share of judges and county
commissioners with the Reznor name.
It doesn't surprise me that they would try something like this. The
pin-heads that I used to have to deal with there were completely out of
touch with the real world and wouldn't know technology if it jumped up and
bit them in the ass!

I am in the HVAC business, and was on the web looking for the Reznor unit
heater site for some acoustical information. I couldn't find a Reznor site
via search engine, so I finally typed in the obvious - www.reznor.com - and
came across you're "open letter" about your dealings with the Reznor
company. Holy cow! Despite the fact I still haven't found the Reznor site
(if one even exists), I can't believe the B.S. they're throwing your way.

BTW - you're right: when you put in "Reznor" in a search engine, the entire

A few years ago Betts used a picture of the founder of the Reznor Mfg. Co.
(George Reznor) in a magazine ad (national trade magazine). They were
apparently trying to use the "nostalgia" aspect in the ad. Someone in the
company decided George Reznor's name wasn't good enough. They intentionally
and dishonestly decided to add the name Thadeus to his name because they
thought it would be more 'marketable'.
So much for goodwill and the Reznor name. They cooked up George Thadeus
Reznor. which was not only an insult to the descendents of George Reznor but
it puts in print a falsehood to the real facts of the good and historical
name of George Reznor.
Having read your piece again... don't sell.

My name is (obscured) and after reading your article about your impending
battle with T & B I felt obligated to give you a little history regarding
Reznor. I am (obscured) of (obcured). One of the product line we've
represented and distributed since my grandfather started the company is
Reznor.
I'm not in the loop of Trent Reznor and though this may be old news, Trent
Reznor is the son of a Reznor (George, I think) who was one of the owners of
Reznor Mfg Co.
(I would think if anyone is heir to the name Reznor it would be a Reznor, if
that is the way it worked)
Reznor was family owned for many years until ITT bought them. ITT did what
ITT does and bled the company until it almost died. Reznor was then sold to
Forstman & Little, another conglomerate who built them up, packaged them with
several other companies then sold them off to T & B. How anyone came up with
the year 1949 as the time when T & B owned Reznor is beyond me.... T & B
purchased Reznor in the 80's.

i suggest taking a look at www.showtime.com and selecting the "who we are not"
section. these guys have long since been bothered by the cable network but
they've held onto their name throughout. the point is, they can write all
the letters they want but they won't be able to win unless you buckle.
they might have a legal leg to stand on if you put up the site for the
express purpose of confusing people or mocking the company. that is clearly
not the case here. the only reason they are acting this way is because they
think you can be bullied. one way to prove that you can't is to post their
letters on your site and start getting some publicity. that is something
they will hate and in all likelihood they will immediately back down. and
if they actually decided to proceed with legal action, they would lose.
but i've never known a company to do something like that unless the site
was clearly obtained for the purposes of extortion.

This is really beginning to annoy me. Here in Denmark we have a simple
rule: Who regs it first, gets it first. Forever. If some bigshot company
got their name registered, too bad. This does have a few side effects
though, like the local ISP's who regged every name in the phonebook and
then started selling them at much higher cost. But still, when you get a
domain, its secured.
Weird how it's always private people who are getting stamped on. I doubt
I'd get redhat.com if I told them my family have been running a bar
